Netflix sued over Bandersnatch's similarities to Choose Your Own Adventure

Bandersnatch was released in December as a feature-length episode of the Black Mirror series.

In the film, Stefan (Fionn Whitehead) explained to his dad that the video game Bandersnatch is based on a book series which he described as "choose your own adventure". In the filing, Chooseco alleges that "Chooseco and Netflix engaged in extensive negotiations that were ongoing for a number of years, but Netflix did not receive a license..."

TMZ reports the streaming giant has been hit with a $25M lawsuit by the creators of "Choose Your Own Adventure" over the latest installment in the Black Mirror series.

According to Variety, Chooseco LLC, the Vermont-based publisher of the book series, claims Netflix "exploited the brand awareness of the book series to launch the show".

According to the suit, Netflix apparently tried to obtain a license for Chooseco's trademark in the past, but wasn't able to reach a deal with the publisher. Chooseco is seeking at least $25 million or Netflix's profits from the film. The movie was billed as a "choose your own adventure" tale, even though the company largely refrained from actually using that phrase in the marketing.

"The misappropriation of our mark by Netflix presents an extreme challenge for a small independent publisher like Chooseco". The franchise was extremely popular during the 1980s, growing to 184 books with more than 250 million copies printed.

Additionally, Chooseco claims that the violent and disturbing nature of the film, including references to drug use and mutilation, tarnishes the brand and is inappropriate for its young audience.

The suit also notes that 20th Century Fox recently optioned the rights to create a film based on the series, which is now in the works.

This is not the first time that Chooseco has gone to court over the use of "Choose Your Own Adventure".
