US judge dismisses Judd claim against Weinstein

Judd was one of the first women in 2017 to publicly accuse Weinstein of sexual misconduct

Judd sued after "Lord of the Rings" director Peter Jackson said he didn't cast her in his films when Weinstein called her a "nightmare" to work with after she turned him down when he propositioned her. But the judge ruled that lawmakers had "modified, rather than clarified" the 1999 law, making it inappropriate to apply its new standards retroactively.

In an attempt to leave the room, Judd says, she made a "mock bargain" with Weinstein, "suggesting that she would consider letting him touch her only if she won an Academy Award in one of his films".

The rest of Judd's case, which includes claims of defamation, intentional interference with prospective economic advantage; and a violation of California's Unfair Competition Law, all for Weinstein's alleged badmouthing of Judd, which she claims significantly hurt her career. She said Weinstein continued to "lord that traumatic event" over her and would mention their "little deal".

In 2018, Ashley claimed Weinstein had defamed her in 1998 by threatening to sabotage her career after she rejected his alleged advances.

Gutierrez took pains to say he "is not determining whether Plaintiff was sexually harassed in the colloquial sense of the term", but only whether the incident fell under the scope of the statute her lawsuit cited.

Philip S. Gutierrez, the US District Court Judge, granted the motion from Weinstein's legal team that the portion of the suit was inadmissible due to the law not covering Weinstein and other producers at the time.

Weinstein's attorney, Phyllis Kupferstein told ET in a statement: "We have said from the beginning that this claim was unjustified, and we are pleased that the court saw it as we did".

'We look forward to pursuing the three claims for relief that the court has already ruled can move forward'.

Judd appeared in Frida and Crossing Over which were distributed by Weinstein's companies (Miramax and The Weinstein Company) in 2002 and 2009 respectively.

Weinstein is now awaiting trial on other sexual misconduct charges.

The disgraced Hollywood producer of movies such as Shakespeare in Love has been accused of sexual misconduct by more than 70 women. He faces five felony charges: two counts of predatory sexual assault, one count of criminal sexual act in the first degree and one count each of first-degree rape and third-degree rape.
