Mandalay Bay owner SUES victims of deadly Las Vegas shooting

MGM Resorts International filed complaints in California and Nevada on Friday arguing that it can not be held legally responsible for the October 1 deaths, injuries, or other damages.

MGM Resorts International, the parent company of Mandalay Bay, is suing more than 1,000 victims to pre-empt liability claims, The Las Vegas Review-Journal reported Monday.

The lawsuits outraged the victims and their lawyers. According to court documents obtained by the Review-Journal, MGM filed the lawsuits in order to avoid being held liable for any injuries or deaths that occurred after Stephen Paddock opened fire from a Mandalay Bay hotel room onto the festival crowd below.

Companies providing such products and services had been reluctant to do so for fear they'd be liable in a terrorist attack, but the 2002 law limits liability and allows companies to assert a government contractor defense for claims stemming from terrorism.

It says the safety act limits liabilities arising from mass attacks in the US, where services certified by the Dept. of Homeland Security were deployed.

The federal lawsuit drew outrage on social media, but MGM said in a statement the filing was meant to "seek a timely resolution" for shooting victims who have sued the company since the attack during the Route 91 Harvest Festival. "Years of drawn out litigation and hearings are not in the best interest of victims, the community and those still healing".

In this case, MGM's lawyers claim, the act and other regulations "make clear that any such claim against the MGM parties must be dismissed".

"The Safety Act was a response by Congress to the terrorist attack of September 11, 2001, to encourage companies to get into the business of developing anti-terrorism technology", Eglet said. "I believe that MGM did this because they did not like the Nevada Federal Judge that is now assigned to our case", Eglet said. The FBI and the Las Vegas Metropolitan Police Department have not determined Paddock's motive and are still investigating.

Fifty-eight people were killed and hundreds were wounded on October 1 when a gunman opened fire on the country music festival from the 32nd floor of Mandalay Bay.

Lawsuits filed in state court against MGM and the concert promoter have accused both of failing to provide adequate security. "It's just really sad that they would stoop to this level", he told the Review-Journal.
