Federal Bureau of Investigation agent Chase Bishop made his second court appearance after his gun discharged and shot a bar patron while he was doing a backflip last month, according to KDVR.

Bishop's lawyer argued during a short court hearing on Tuesday that the Federal Bureau of Investigation strongly encourages its agents to carry their service weapons while not on the clock.

Bishop faces a felony charge of second-degree assault, which carries a maximum sentence of 12 years in prison.

During Tuesday's court hearing, Bishop's attorney, David Goddard, said prosecutors had offered the agent a plea deal but declined to elaborate when later questioned by reporters. Prosecutors didn't object so Judge Fran Simonet said Bishop could be armed while on- and off-duty.

Chase Bishop, 29, was charged with second degree assault after a bar patron was shot in the leg when the agent's gun went off in the Denver, Colorado club on June 2. The lawyer said that Federal Bureau of Investigation agents are urged to carry their guns with them even when they are not on duty.

However, Bishop's job status isn't known, and the bureau's press office did not immediately respond to a request for information about whether he is now working.

Bishop, who is based in Washington DC, was also allowed to travel as long as he appears at court hearings in Denver when mandated.

The agent was then seen placing the gun back into his holster before walking off the dance floor.

The bystander, Tom Reddington, was treated and released from a hospital.

Reddington, who has hired a lawyer, said he lost a lot of blood and that he "soaked through several blankets, several towels, a few gauze pads".

In an interview less than a month after the shooting, Mr Reddington, who had recently moved to Denver from Chicago, said he did not blame the agent. I'm not vindictive at all. At this point, there's nothing we can do to fix it.
