Bethesda suing Warner Bros. over new Westworld mobile game

Both Games Feature Multi Room Underground Facilities to Manage

Warner Bros. has been slapped with a lawsuit from Bethesda over its Westworld mobile game, calling it a "blatant rio-off" of Fallout Shelter.

Bethesda is taking Warner Bros. and Behaviour Interactive to court over the recently released Westworld mobile game. And if Bethesda can prove it, that's pretty damning evidence that Behaviour did in fact build Westworld using Fallout Shelter source code.

Bethesda alleged that Behaviour, a Montreal studio which developed the original Fallout Shelter at the behest of Bethesda, used the same copyrighted computer code created for Fallout Shelter in Westworld. Anyone who has successfully copied their friend's homework in the third grade is surely shaking their head in furious curiosity over how such an obvious mistake could be made.

Bethesda filed a federal lawsuit in Maryland (where Bethesda is based) against Warner Bros.

Court documents reportedly state that Bethesda believes Behaviour Interactive has stolen its designs, artwork, and code, going on to use them again in this latest project in conjunction with Warner. For example, the demonstration version of the Westworld game includes a visible software "bug" or code defect present in an early version of FALLOUT SHELTER code delivered by Behaviour to Bethesda during game development. Warner Bros. declined to comment. If the two games sound familiar, well, the company behind Fallout is alleging that's because they got ripped off.

If you're interested in seeing what both games are about, and judging the merits of the case for yourself, Westworld is out on Android and iOS. The new lawsuit filed yesterday, however, alleges Behaviour actually used some of the same underlying code for both games, which would put it in breach of its contract with Bethesda. "As a result of Behaviour and Warner Bros" unlawful conduct, "Westworld" is a blatant ripoff of "Fallout Shelter" with largely superficial, cosmetic changes. A bug allows for the demo version of Westworld to appear out of focus. Specifically, the view is out-of-focus and the scene that appears is far to the right and below the targeted landscape image.
