German ministry says 774000 Mercedes cars contain unauthorized software

The Stuttgart-based carmaker has said the US Department of Justice has inquired about the company's emission certification processes, and that German prosecutors in Stuttgart are investigating Daimler employees on suspicion of fraud and criminal advertising. A device can be classified as illegal if exhaust filtering systems are deactivated too early or without good reason. The report claims that, during KBA's investigation, five "illegal switch-off devices" have been discovered in the bulk of the automaker's Euro 6 diesel motors, encompassing at least one million vehicles in total.

The affected vehicles include the Mercedes-Benz Vito delivery van and the Mercedes GLC 220d and C220d.

Mercedes-Benz is disputing whether or not the devices are indeed illegal, but would not confirm how many vehicles they were installed in.

Recent weeks have seen Germany´s KBA vehicle licensing authority hit Volkswagen subsidiaries Audi and Porsche with mass recall orders over their engine control software, as well as a smaller batch of cars from rival BMW.

It's now unclear how many models in the United Kingdom are impacted.

Daimler Chief Executive Dieter Zetsche said on Monday that the carmaker had found a technical solution for updating the software on its vehicles, and he therefore expected the company would avoid a fine.

"In our integrated emission control systems, there are several hundred functions interlocked with each other, which can not be considered independently from each other", a Daimler spokesperson told The Drive. "Those functions are part of a complex emission control system created to ensure robust emission control in different driving conditions and over the lifetime of a vehicle". We will file an objection against the decision issued by the KBA (German Federal Motor Transport Authority).

Daimler said in a statement only that it "confirmed the recall" and added that "open legal questions will be clarified in appeal proceedings".

Evercore ISI analyst Arndt Ellinghorst predicted the costs for the required software update for Daimler would be less than 100million euros (£88million).

'Overall, this outcome should de-risk the stock'.
