Hold Onto Yr Wanderlust: Coachella Is Being Sued By A Rival Festival

DJ Marshmello performs in the Sahara Tent during the Coachella Valley Music & Arts Festival at the Empire Polo Club

Soul'd Out Productions, which organises Soul'd Out Music Festival in April, says a contractual restriction (dubbed the "radius clause") that prevents acts on the Coachella bill from playing at "any other festival or themed event within a distance that extends over 1,300 miles" amounts to anti-competitive behaviour on the part of organisers.

Coachella is set to kick off this Friday in Indio, California, and will run across two weekends before wrapping up on April 22nd.

Radius clauses are nothing new, and though Soul'd Out Productions' lawsuit is important in its visibility, another important anti-radius clause lawsuit is well underway in IL. "We look forward to having a Portland jury hear Soul'd Out's complaint".

Coachella is an annual musical event near Palm Desert, California nearly 1,100 miles from Portland.

"By means of this clause, Defendants prohibit artists who seek to perform at Coachella from performing at any other festival or themed event within a distance that extends over 1,300 miles (2,092 km), and for a period of almost five months surrounding Coachella", the lawsuit noted.

Organizers of the Coachella music festival force bands to sit out all other west coast festivals for the six months surrounding Coachella, according to a federal lawsuit filed by Portland's annual Soul'd Out Festival. It seeks an injunction against the radius clause, and compensation for claimed damages.

Aldrich is accusing Goldenvoice and AEG of violating anti-trust statues by "unreasonably restricting price and cost of competition among live concert venues" and "limiting entry or expansion of competitors" in "the states of California, Nevada, Oregon, Washington, or Arizona" which they allege hurts fans and smaller concert promoters. "The argument that consumers would be hurt is that the artists don't have a choice [of where to play]", Carrier told The Outline by phone.

One big mystery in this entire ordeal is just how wide Coachella's radius has grown over the years.

Soul'd Out, which grossed $2 million in 2017, says Coachella's illegal contract has hampered its ability to thrive, by causing "numerous artists" to turn down offers to perform in Portland due to their agreements with Coachella.

The people behind the festival are not staying completely silent, however.
