ICE grants deportation stay to father of 5-year-old leukemia patient

"In an exercise of discretion, ICE has granted Jesus Armando Berrones-Balderas a one-year stay of removal on humanitarian grounds", a statement by the U.S. Immigration and Customs Enforcement office in Phoenix said.

The undocumented father of a 5-year-old with leukemia received a one year stay from deportation on Monday after taking refuge at a local church. But following Donald Trump's inauguration, Berrones was told during an ICE meeting in June that he would need to check in more frequently.

His U.S. citizen wife is pregnant with their sixth child, and his five-year-old son Jayden is battling leukemia.

His wife, Sonia Garcia, and their five children are American citizens. He had checked in regularly with ICE until December, at which time he was told he was being deported.

One month later in May 2010, Berrones was deported from the United States as an "expedited removal" after encountering federal immigration authorities, according to an ICE official. "I really don't want to be deported because I don't have life over there".

As an adult, Berrones married a US citizen and together they take care of five children, two of whom are from a previous relationship.

The one-year stay granted Monday will allow Berrones to receive a work permit and remain in the US while he tries to have his deportation case reopened so he can apply to remain in the country legally through his USA citizen wife, Wilkes said. Paperwork for a stay was filed but was initially denied February 8.

He had taken refuge in a church in Phoenix, Arizona, over the weekend in order to avoid deportation.

He told Lemon that his son welcomes the news of his stay. Meanwhile, Berrones and his family are inside the church, praying for help.
