AG: Girl can use medical marijuana at school

The Surin parents said the marijuana treatment has been incredibly helpful for their daughter since acquiring her state medical marijuana card in December.

Her parents say it treats the epilepsy she developed after undergoing chemotherapy for leukemia. Her parents spent several years using "traditional" medications to deal with her seizure disorder but nothing worked, according to a federal lawsuit. For months past year, Ashley had to use a wheelchair after hitting her head during a particularly bad seizure.

Previously, the state's marijuana laws made it illegal for individuals to possess medical marijuana on school grounds or school property such as school buses.

The ruling comes after the girl's parents sued Schaumburg School District 54 for the right to take medical marijuana at school.

"All we wanted was for her to be back in school with her friends on her diet, on her medicine and just go on with her 11-year-old life, and that's why we're here", Surin says.

School district officials said they will administer cannabis to the sixth grader until they get further clarification from the attorney general. On Friday, the state's Attorney General Office assured the Surins and the Schaumburg, Illinois School District 54 that Ashley could use medical marijuana without fear of prosecution.

Ashley has been using a medical marijuana foot patch and rubbing oil with positive results.

"Our firm represents over a hundred school districts in IL and the ramifications of this today will be felt throughout the state", said Darcy Kriha, attorney for School District 54. "That's why I think it's mission critical the legislation be revised to reflect the effectiveness of these meds and how it benefits, not just our daughter, but for other students, other kids", said Jim Surin, Ashley's father. The school says she can't bring her treatments to Hanover Highlands Elementary School, according to the suit filed Wednesday in Chicago federal court.

Ashley has been out of school for about two weeks as this legal drama unfolded.
