Walmart ordered to pay $7.5 million in watermelon mishap

A jury in Alabama says Walmart must pay a man $7.5 million after he was injured trying to buy a watermelon

Mr Walker, a retired army sergeant, won $2.5m in compensatory damages and $5m in punitive damages.

"Walmart continues to display watermelons in the same manner as it did on June 25, 2015", the Arkansas-based company in a court filing on Wednesday. Walker didn't realize his foot was stuck, and after he turned away from the display, he fell and broke his hip.

A jury has awarded $7.5m (£5.7m) to a customer who was injured while picking up a watermelon at a Walmart in the U.S. state of Alabama. That led him to fall and shatter his hip, according to court documents described by The Washington Post.

"We are disappointed in the verdict", Walmart spokesman Randy Hargrove said Thursday.

Walmart was represented by Vaughn Russell of Birmingham and Scott Sasser of Lee County.

Walmart had a responsibility to its customers to provide a safe environment and should have known the pallet could cause an injury, his lawyers argued.

In court records and in testimony, Walmart has maintained that the display was not risky, and that any negligence was Walker's fault.

O'Hara said of Walker's distressing situation, "You don't expect to go into a grocery store walking fine on your two feet and come out on a stretcher".

"It was a fair verdict because Walmart just didn't care", attorney Charlie Gower told the Ledger-Enquirer.

The incident reportedly "completely changed Henry Walker's life". In fact, the same displays are still used, it said.

"He is no longer able to do everyday activities that many of us take for granted".
