Qualcomm Fined Record $773 Million in Taiwan Antitrust Probe

Reuters

In a filing Wednesday, the Taiwanese Fair Trade Commission ruled that Qualcomm violated the country's laws by licensing its patents unfairly.

Following this announcement, Qualcomm responded by saying that it disagrees and will be appealing to the decision made by Taiwanese courts once they have time to review what the TFTC has to say. While the regulatory and legal attacks differ in some details, a key theme is the allegation that Qualcomm uses its dominant position in the market for modem chips to charge unfair royalty rates for its patents. Taiwan is only the latest country to go after Qualcomm over its expensive and onerous licensing terms: China and South Korea have both fined the company in the past two years, and Apple is now engaged in a series of global lawsuits against Qualcomm over numerous same practices. Its intellectual-property business, though, is far more profitable, accounting for roughly 80% of the company's pretax profit past year. While you're most likely to have heard of the company because of its Snapdragon processor line, which powers most major Android phones, Qualcomm makes most of its money from licensing patents. "One is the fine for conduct in the past, but the other is making changes to fix it going forward".

Qualcomm's shares were up 23 cents at $54.10 in early trading Wednesday on the Nasdaq exchange. Back in January, Apple sued Qualcomm for allegedly withholding $1 billion in rebates because it complied with Korean regulators investigating Qualcomm. The company is also being investigated by regulators around the world including South Korea, China, Japan, the European Union, and elsewhere for similar violations.
